Wayfare Pet Care Client Service Agreement, Waiver & Veterinary Release

Company: Wayfare Pet Care, LLC, a limited liability company registered in Pennsylvania ("Wayfare," "Company," "we," "our," or "us")
Client: The pet owner creating an account or booking services ("Client," "you," or "your")
Please read this Agreement carefully in its entirety before signing. Both parties retain a signed copy.
By signing below or creating an account with Wayfare Pet Care, you acknowledge that you have read, understood, and agree to the following legally binding terms.
Part I – Terms of Service
1. Services Provided
Wayfare provides professional pet care services, including:
- Dog walking
- Pet sitting and drop-in check-ins
- Add-on household services (trash/recycling, watering plants, organizing toys, bringing in mail)
- Additional services as agreed upon in writing (see Section 5 – Scope Creep & Extra Services)
Services will be performed with care and in accordance with industry standards. Services may be performed by Company employees or qualified independent contractors; however, Company remains solely responsible as the contracting party.
2. Client Responsibilities
You agree to:
- Provide accurate and current information about each pet's health, behavior, vaccination status, and needs.
- Keep all pets up to date on vaccinations.
- Supply safe collars, harnesses, and leashes.
- Ensure safe and unobstructed access to your premises for Wayfare staff.
- Inform Wayfare of any changes to your pet's health, behavior, or household conditions promptly.
- Disclose any known bite history, aggression toward people or animals, or veterinary restrictions (see Section 8).
- Maintain adequate supplies (litter, waste bags, cleaning products, food) as applicable to booked services.
Failure to comply with any of the above may result in refusal or immediate termination of service.
3. Scheduling & Cancellations
- All bookings must be made through the Wayfare scheduling system.
- Cancellations made within 24 hours of a scheduled service may be billed at 100% of the visit rate.
- Recurring services and associated payments will auto-renew on the 1st of each month for previously selected service dates, unless adjusted prior to renewal. Clients may adjust their schedule through the Wayfare website or in response to the renewal reminder email sent seven (7) days prior.
- Wayfare Pet Care does not provide services on Sundays unless explicitly authorized in writing by the CEO. No Sunday bookings will be accepted or honored without prior written CEO approval. Clients will be notified at onboarding and again if a Sunday booking is attempted.
- Wayfare reserves the right to decline or cancel service if safety, legal, or ethical concerns arise, with as much advance notice as circumstances permit.
4. Fees & Payment
- Payment is due at booking unless otherwise agreed in writing.
- Late payments may accrue interest at the maximum rate permitted by Pennsylvania law.
- Client is responsible for all collection costs, including reasonable attorney's fees, if applicable.
- Wayfare Plus subscription members are subject to additional terms provided at time of enrollment, including auto-renewal, cancellation notice requirements, and benefit descriptions. Subscription benefits apply only during active enrollment and are forfeited upon cancellation without proration, unless otherwise stated in the subscription terms.
5. Scope Creep & Extra Services
Wayfare's standard service offerings are listed in Section 1. Any services requested beyond the standard scope — including but not limited to additional cleaning tasks, errands, household maintenance, or specialized animal care — must be agreed upon in writing prior to the service date. This Agreement, a signed addendum, or a written confirmation via text or email from a Wayfare representative constitutes sufficient written agreement for extra services.
Verbal agreements for extra services are not binding on Wayfare. Wayfare reserves the right to decline any extra service request that falls outside its expertise, licensing, or staffing capacity. Extra services may be subject to additional fees, which will be disclosed prior to performance.
6. Operating Hours & Sunday Closure
Wayfare Pet Care operates Monday through Saturday. In observance of the Sabbath, Wayfare does not provide services on Sundays. Clients booking services that extend through a weekend are advised to plan accordingly. Sunday service will not be scheduled or honored unless explicitly authorized in advance and in writing by the Chief Executive Officer of Wayfare Pet Care. Any such authorization is made at the sole discretion of the CEO and does not constitute a waiver of this policy for future requests.
Part II – Liability Waiver & Indemnification
7. Assumption of Risk
You understand that pet care carries inherent risks, including illness, injury, escape, property damage, or death. You voluntarily accept all such risks associated with the provision of services under this Agreement.
8. Bite History & Aggression Disclosure
Client is required to disclose, in writing and prior to the first service visit, any known history of biting, aggression toward people or other animals, fear-based reactivity, or any incident in which the pet caused physical harm to a person or animal. This disclosure requirement applies to all animals present at the service property, not only those directly receiving care.
Failure to disclose known bite history or aggression constitutes a material misrepresentation and releases Wayfare from all liability arising from any incident involving that animal. In the event of an undisclosed bite or aggression incident, Client agrees to indemnify Wayfare fully for all resulting costs, damages, medical expenses, and legal fees.
9. Release of Liability
To the fullest extent allowed by law, you release and hold harmless Wayfare, its employees, contractors, and affiliates from any liability arising from:
- Illness, injury, or death of your pet(s), except where caused by gross negligence or willful misconduct by Wayfare.
- Injury or damage caused by your pet(s) to people, animals, or property.
- Disease transmission between pets.
- Natural disasters, theft, or other events outside Wayfare's reasonable control.
- Undisclosed health conditions, behavioral issues, or bite history.
Access Authorization: Client authorizes Wayfare to access Client's premises using the method provided (keys, lockbox, smart entry). Client releases Wayfare from liability for ordinary loss, theft, or damage, except where caused by gross negligence.
Key Management: Wayfare will retain any key or access credential provided by Client for the duration of the service relationship. Upon termination of this Agreement, Wayfare will return all keys or access credentials to Client within five (5) business days, or leave them at the property on the final day of service, as mutually agreed. Client acknowledges responsibility for any consequences arising from rekeying, lockbox code changes, or smart entry modifications made without notifying Wayfare.
Insurance Disclosure: Wayfare maintains General Liability Insurance with the following coverage:
- $1,000,000 per incident / $2,000,000 aggregate
- Products-Completed Operations Aggregate: $2,000,000
- Personal & Advertising Injury: $1,000,000
- Damage to Premises Rented: $100,000
- Medical Expense: $5,000 per person
- Animal Bailee (Care, Custody, Control): $5,000 per incident / $10,000 aggregate
- Veterinarian Expense Reimbursement: $1,000 per incident / $5,000 aggregate ($250 deductible)
- Lost Key Liability: $2,000 per incident / $2,000 aggregate
Client acknowledges that insurance is subject to stated limits, exclusions, and deductibles, and that the Company does not provide veterinary or pet health insurance.
10. Indemnification
You agree to indemnify, defend, and hold harmless Wayfare against any claims, damages, or expenses (including reasonable attorney's fees) resulting from:
- Your pet's actions or behavior, including biting, aggression, or property damage.
- Your breach of any provision of this Agreement.
- Misrepresentation of your pet's health, history, or behavioral condition.
- Any undisclosed bite history or aggression that results in harm to a person, animal, or property.
Part III – Veterinary Authorization & Emergency Care
11. Veterinary Authorization
If your pet becomes sick or injured while in Wayfare's care, you authorize Wayfare to:
- Seek veterinary treatment at the nearest available licensed veterinary facility.
- Transport your pet if necessary.
- Make care decisions in good faith on your behalf until you can be reached.
12. Financial Responsibility
You accept full financial responsibility for all veterinary costs incurred as a result of emergency care, including exams, treatments, medications, hospitalization, or humane euthanasia if medically required and you are unreachable. Wayfare will make all reasonable efforts to obtain your authorization before any non-emergency procedure.
13. Emergency Protocols
Wayfare will attempt to contact the Client immediately in any emergency situation. If the Client is unreachable, Wayfare will act in the best interest of the pet's health and safety. Wayfare shall not be liable for any treatment decisions made in good faith during such emergencies.
Part IV – Photo, Content & Platform Terms
14. Photo & Content Release
Wayfare may capture photos or videos of pets during service visits for the purpose of client visit reports and updates delivered privately to the Client. Any use of pet photos or videos for marketing, social media, website, or promotional purposes is governed exclusively by a separate Photo & Media Release Form, which is provided at onboarding and requires explicit written consent. No photos or videos will be used for marketing purposes without a signed release form on file.
15. Third-Party Platforms & Booking Channel Policy
Clients who initially contact or discover Wayfare through a third-party platform (including but not limited to Thumbtack, Rover, Nextdoor, or Care.com) agree that all ongoing, recurring, or future services will be booked and managed exclusively through Wayfare's official scheduling system at wayfarepetcare.com. Circumventing Wayfare's booking system to avoid platform fees, whether at the suggestion of a third-party platform or otherwise, does not affect Client's obligations under this Agreement.
Part V – Termination
16. Termination by Client
Client may terminate this Agreement at any time by providing seven (7) days' written notice to Wayfare via text or email. All outstanding balances for services already rendered are due and payable upon termination. Any prepaid amounts for services not yet performed will be refunded on a prorated basis within fourteen (14) days of termination.
17. Termination by Wayfare Pet Care
Wayfare may terminate this Agreement with seven (7) days' written notice for any reason. Wayfare may terminate immediately and without prior notice under any of the following conditions:
- Non-payment or chronic late payment of fees.
- Unsafe, threatening, or hostile conditions at the service property toward Wayfare staff.
- Discovery of animal abuse, neglect, or conditions endangering animal welfare.
- Material misrepresentation by Client regarding the scope of services, pet health, bite history, or property conditions.
- Any undisclosed bite or aggression incident that results in harm to a Wayfare staff member.
- Any condition that places the safety of Wayfare personnel at risk.
18. Effect of Termination
Upon termination by either party, Wayfare has no further obligation to perform services. All access credentials will be returned to Client within five (5) business days of termination. Outstanding balances remain due regardless of which party initiates termination.
Part VI – General Provisions
19. Charitable Giving Disclosure
Wayfare Pet Care donates a portion of every booking to local animal shelters. By booking services, Client acknowledges this practice. The specific donation amount and recipient shelters may change over time and are at the discretion of Wayfare Pet Care.
20. Governing Law
This Agreement is governed by the laws of the Commonwealth of Pennsylvania.
21. Dispute Resolution
Both parties agree to attempt good-faith mediation in Centre County, PA, before pursuing litigation. If mediation fails to resolve the dispute within thirty (30) days, either party may pursue appropriate legal remedies.
22. Compliance with Animal Welfare Laws
Wayfare operates in compliance with all applicable state and federal animal welfare laws, including Pennsylvania Dog Law and relevant consumer protection statutes.
23. Severability
If any clause of this Agreement is deemed unenforceable by a court of competent jurisdiction, the remainder of the Agreement remains valid and in full force.
24. Entire Agreement
This Agreement represents the entire understanding between Client and Company and supersedes all prior agreements, conversations, or representations. Any modification to this Agreement must be made in writing and signed or acknowledged by both parties.
25. Assignment & Franchise
Wayfare Pet Care reserves the right to assign this Agreement to a qualified successor, affiliate, or franchisee operating under the Wayfare Pet Care brand, provided that Client receives reasonable written notice of any such assignment. The successor or franchisee will assume all obligations under this Agreement. Client may not assign this Agreement without Wayfare's prior written consent.
26. Force Majeure
Company shall not be liable for any failure or delay in performing services due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, labor disputes, government actions, power outages, or internet disruptions. Wayfare will make reasonable efforts to notify Client and reschedule affected services as soon as practicable.
27. Electronic Consent
By checking the acknowledgment box, creating an account, or signing below, Client agrees that this electronic or physical agreement has the same legal effect as a handwritten signature under Pennsylvania law and the Electronic Signatures in Global and National Commerce Act (E-SIGN).
28. Binding Effect
This Agreement applies to and binds both Parties, their heirs, legal representatives, and successors.
